Terms of Service

These Terms of Service ("Terms") govern access to and use of the Oraoki web app, mobile app, and related services (the "Services") provided by Oraoki ([ABN]) ("Oraoki", "we", "us", or "our").
Oraoki is an all-in-one rostering, housekeeping, maintenance, inspection, and messaging platform for hostels and other accommodation providers. By creating an account, accepting an invitation, using a staff access code, or using the Services, you agree to these Terms.
If you use the Services for an organisation, you represent that you are authorised by that organisation to use the Services. If your organisation has a separate written agreement with us, that agreement applies to the organisation's subscription and prevails over these Terms to the extent of any inconsistency.
Who may use Oraoki
The Services are for authorised staff, contractors, managers, administrators, and other users approved by participating hostels or accommodation providers. The Services are not intended for public guest bookings, consumer travel purchases, or children under 13.
Accounts and access codes
Accounts, roles, permissions, and staff access codes are issued or approved by your organisation. You are responsible for keeping your credentials, PIN, staff code, and device secure. You must not share access with anyone who is not authorised by your organisation.
You are responsible for activity under your account or access session, except where that activity results from our breach of these Terms or applicable law. Tell your organisation or us promptly if you believe your account, code, or device has been compromised.
Acceptable use
You must:
- use the Services only for lawful business purposes connected with your organisation's property operations;
- enter accurate operational information to the best of your knowledge;
- respect the confidentiality of guest, staff, and property information you access through Oraoki;
- use camera, photo, messaging, and maintenance features only for legitimate operational purposes; and
- comply with your organisation's policies and all applicable laws.
You must not:
- try to access data belonging to another organisation or unauthorised user;
- probe, scan, bypass, or test our security controls without written permission;
- upload malware, unlawful content, abusive content, or content that infringes another person's rights;
- use the Services for surveillance, harassment, discrimination, or any unlawful employment practice;
- reverse engineer, scrape, overload, or interfere with the Services except as permitted by law; or
- use the Services in a way that could damage Oraoki, another customer, or the public.
Organisation data and user content
Your organisation retains its rights in data submitted to the Services, including rosters, room records, maintenance tickets, inspection notes, messages, photos, and attachments ("Customer Data"). You grant us a limited licence to host, process, transmit, display, back up, and otherwise handle Customer Data only as needed to provide, secure, support, and improve the Services and comply with law.
You must only upload or enter Customer Data that you are authorised to provide. Do not enter unnecessary sensitive information about guests, staff, or others. Your organisation is responsible for the instructions it gives users and for the legality of its operational use of the Services.
Privacy
Our Privacy Policy explains how we collect, hold, use, and disclose personal information. By using the Services, you acknowledge that personal information will be handled as described in that policy.
Account closure and deletion
Full user accounts may be closed from the mobile app where the feature is available. Staff-code sessions and organisation-managed accounts may need to be handled by your organisation's administrator. Closing an account removes or disables account credentials and signs the user out.
Some operational records may be retained after account closure where required or permitted for employment, tax, accounting, safety, audit, dispute, legitimate business, or legal reasons. See the Privacy Policy for more detail.
Third-party platforms
The mobile app is distributed through app stores operated by Apple and Google. Those platforms may apply their own terms and privacy policies. Apple and Google are not responsible for the Services, support, maintenance, or claims relating to the Services, except to the extent their own terms or applicable law say otherwise.
Intellectual property
We and our licensors own the Services, including software, designs, branding, documentation, and related intellectual property. Except for rights expressly granted to you, no rights are transferred to you. You must not copy, modify, distribute, sell, or lease any part of the Services unless we agree in writing or the law permits it.
Availability and changes
We aim to provide reliable Services, but we do not guarantee uninterrupted or error-free access. Maintenance, outages, third-party failures, emergencies, or security issues may affect availability. We may update, improve, suspend, or discontinue features from time to time.
Not an emergency service
Oraoki is an operational workflow tool. It is not an emergency communications system and should not be relied on for urgent threats to life, safety, property, or legal compliance. Use your organisation's emergency procedures and contact emergency services where appropriate.
Australian Consumer Law and warranties
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law or other applicable law. Subject to those non-excludable rights, the Services are provided "as is" and "as available", and we disclaim warranties to the maximum extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profits, revenue, goodwill, data, or business opportunity. To the extent our liability cannot be excluded but can be limited, our liability is limited to resupplying the Services or paying the cost of resupply.
If your organisation has a separate written agreement with us, the liability terms in that agreement apply to the organisation's use of the Services.
Indemnity
To the extent permitted by law, you indemnify us against losses, claims, and expenses arising from your misuse of the Services, breach of these Terms, unauthorised disclosure of data, or violation of law, except to the extent caused by our breach of these Terms or negligence.
Suspension and termination
We may suspend or terminate access where reasonably necessary for security, non-payment by an organisation, breach of these Terms, suspected misuse, legal compliance, or to protect the Services, customers, users, or the public. Your organisation may also remove or change your access at any time.
Sections that by their nature should survive termination will survive, including privacy, customer data, intellectual property, disclaimers, limitations of liability, indemnity, and governing law.
Changes to these Terms
We may update these Terms from time to time. The "Last updated" date will change when we do. Material changes may be communicated through the Services, by email, or through your organisation where appropriate. Continued use after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of Australia and, where a State or Territory must be selected, the laws of New South Wales, Australia, unless your organisation's separate written agreement states otherwise. You submit to the non-exclusive jurisdiction of the courts of Australia, subject to any mandatory rights that apply in your location.
